Document Overview

This notice can only be used to end a periodic, or rolling, lease. To end a fixed-term lease at the prescribed end date, see Notice of Non-Renewal of Lease (Fixed Term Residential Lease).

This notice may be legally required. In New South Wales, Tasmania, Queensland, Victoria and the ACT, no-grounds eviction is not legal under any circumstances. These laws are subject to change.

The term "eviction" here is used in the sense of exercising a right to end the lease. This is not valid as a way of initiating forceful eviction proceedings.

This notice may be followed up with a reminder as the date of the end of the lease approaches, such as the End of Lease Reminder (Residential Lease) on the Lawpath platform.

The Legal Risk Score of a No-Grounds Eviction Notice (Periodic or Rolling Lease) Template

Our legal team have marked this document as medium risk considering:

  • If poorly managed, an eviction notice can put you at risk of breaching residential tenancy legislation.
  • The document doesn't provide any further right to explain or appeal to the tenant.
  • The document may make the tenant hostile.

Users familiar with leasing may find it easy to use but should ensure thorough completion to avoid gaps that could affect the document's effectiveness and clarity in meeting its goals.
